This is a secondary appeal in a case arising under the Hawaii Workers Compensation Law, Hawaii Revised Statutes (HRS) Chapter 386. Employer-Appellant Green Magic, Inc. and Insurance Carrier-Appellant Hawaii Employers Mutual Insurance Company, Inc. (collectively, "the Employer") appeal from the "Order Dismissing Appeal" filed by the Labor and Industrial Relations Appeals Board (LIRAB) on June 3, 2008. The LIRAB dismissed the Employers appeal of the decision of the Director of the Department of Labor and Industrial Relations (Director) in favor of Appellee The Queens Medical Center, Inc. (Queens) in a billing dispute over the cost of medical services. The LIRAB cited Hawaii Administrative Rules (HAR) 12-15-94(d), which provides that the decision of the Director in a medical services billing dispute "is final and not appealable," in ruling that the LIRAB lacked jurisdiction to review the Directors decision.
